65);">老有所养、老有所医、老有所为、老有所学、老有所乐</span></strong>。近日，寻乌县人民法院根据《中华人民共和国民法总则》《中华人民共和国婚姻法》《中华人民共和国老年人权益保障法》等法律法规的相关规定，特向寻乌全县人民发出《关于提倡敬老孝老、打击不孝行为、防止因老致贫》的通告。</section></section></section><section style="font-size: 16px;color: rgb(255, 41, 65);"><strong>六十周岁以上</strong></span><span style="font-size: 16px;">的公民。保障老年人合法权益是家庭赡养义务人的法定责任，也是全社会的共同责任。</span><span style="font-size: 16px;color: rgb(255, 41, 65);"><strong>禁止歧视、侮辱、虐待或者遗弃老年人</strong></span><span style="font-size: 16px;">。国家保障老年人依法享有的权益。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">二、赡养人是指老年人的子女以及其他依法负有赡养义务的人。赡养人的配偶应当协助赡养人履行赡养义务。</span><strong><span style="font-size: 16px;color: rgb(255, 41, 65);">赡养人应当履行对老年人经济上供养、生活上照料和精神上慰藉的义务，照顾老年人的特殊需要</span></strong><span style="font-size: 16px;">。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">三、下列行为属于对老人的</span><span style="font-size: 16px;color: rgb(255, 41, 65);"><strong>不孝</strong></span><strong><span style="font-size: 16px;color: rgb(255, 41, 65);">行为</span></strong><span style="font-size: 16px;">：</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">1.赡养人住新房，让老年人住危房、旧房的；</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">2.强迫老年人居住或者迁居条件低劣的房屋的；</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">3.侵占老年人自有、承租的住房，或者擅自改变产权关系或者租赁关系的；</span></p><p style="line-height: 2em;text-indent: 0em;text-align: center;"><span style="font-size: 16px;"></span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">4.故意要求被赡养人分开居住又长期不探望照顾的；</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">5.不保障被赡养人饮水安全、吃饭、吃肉等基本生活所需的；</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">6.不保障被赡养人穿衣、防寒、保暖等基本生活所需的；</span></p><p style="line-height: 2em;text-indent: 0em;text-align: center;"><span style="font-size: 16px;"></span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">7.被赡养人患病不及时安排治疗和护理，或者对经济困难的老年人，不提供医疗费用的；</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">8.对生活不能自理的老年人，赡养人不承担照料责任；不能亲自照料老年人，又不按照老年人的意愿，委托他人或者养老机构照料的；</span></p><p style="line-height: 2em;text-indent: 0em;text-align: center;"><span style="font-size: 16px;"></span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">9.赡养人不承担耕种或者委托他人耕种老年人承包的田地的义务，不承担照管老年人的林木和牲畜等义务，并将应当归老年人所有的收益占为己有的；</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">10.要求老年人承担力不能及的劳动的；</span></p><p style="line-height: 2em;text-indent: 0em;text-align: center;"><span style="font-size: 16px;"></span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">11.家庭成员不关心老年人的精神需求，长期忽视、冷落老年人的；</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">12.子女或者其他亲属干涉老年人离婚、再婚及婚后的生活或以老年人的婚姻关系变化、放弃继承权等为由拒绝承担赡养义务的。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">四、赡养人、扶养人不履行赡养、扶养义务的，</span><span style="font-size: 16px;color: rgb(255, 41, 65);"><strong>基层群众性自治组织、老年人组织或者赡养人、抚养人所在单位</strong></span><span style="font-size: 16px;">应当督促其履行。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">五、老年人因其合法权益遭受侵害发生的民事纠纷，可以申请</span><strong><span style="font-size: 16px;color: rgb(255, 41, 65);">人民调解委员会、村委会、居委会、乡（镇）司法所、老年人组织、村理事会或者赡养人所在单位等</span></strong><span style="font-size: 16px;">机构进行协商调解，通过调解，各方协商一致所依法达成的协议当事人应遵照履行。</span></p><p style="line-height: 2em;text-indent: 0em;text-align: center;"><span style="font-size: 16px;"></span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">六、老年人因</span><strong><span style="font-size: 16px;color: rgb(255, 41, 65);">赡养费、扶养费、养老金、抚恤金、医疗费以及婚姻</span></strong><span style="font-size: 16px;">等纠纷提起诉讼的，人民法院将依法及时立案、及时审理、及时执行。同时，老年人可以申请</span><span style="font-size: 16px;color: rgb(255, 41, 65);"><strong>缓交、减交或者免交</strong></span><span style="font-size: 16px;">诉讼费。支持律师事务所、公证处、基层法律服务所和其他法律服务机构为经济困难的老年人提供免费或者优惠服务。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">七、</span><strong><span style="font-size: 16px;color: rgb(255, 41, 65);">对老年人实施家庭暴力、遗弃、虐待老人等其他不孝行为构成违法或犯罪的，依照相关法律规定办理。</span></strong></p><p style="line-height: 2em;text-indent: 0em;text-align: center;"><strong><span style="font-size: 16px;color: 16px;">八、提倡和鼓励老年人通过合法渠道和途径主动维护自身的合法权益，不提倡为顾全自身或其近亲属的面子而甘愿让自身合法权益受损的错误思想与做法，防止助长不孝老、不敬老的不良社会风气进一步蔓延。</span></p><p style="line-height: 2em;text-indent: 0em;text-align: center;"><span style="font-size:
