江西赣州：制售二氧化硫超标辣椒，10倍赔偿
<section data-role="outer" label="Powered by 135editor.com" style="font-family: 微软雅黑;"><section data-role="outer" label="Powered by 135editor.com"><section class="_135editor" data-tools="135编辑器" data-id="86318" style="border-width: 0px;border-style: none;border-color: initial;box-sizing: border-box;"><section style="margin-right: auto;margin-left: auto;" class="layout"><section style="margin-top: 2em; padding-top: 0.5em; padding-bottom: 0.5em; font-family: inherit; font-size: 1em; font-weight: inherit; line-height: 22.4px; border-style: solid none none; border-top-width: 1px; border-top-color: rgb(204, 204, 204); text-decoration: inherit; color: rgb(166, 166, 166); box-sizing: border-box;"><section style="margin-top: -1.2em;text-align: center;border-width: initial;border-style: none;border-color: initial;line-height: 1.4;box-sizing: border-box;"><br></section></section></section></section><p style="max-width: 100%;min-height: 1em;overflow-wrap: break-word !important;"><br></p><section class="_135editor" data-tools="135编辑器" data-id="88501" style="border-width: 0px;border-style: none;border-color: initial;box-sizing: border-box;"><section style="display: inline-block;width: 100%;vertical-align: top;border-width: 1px 4px 4px 1px;box-sizing:border-box;border-radius: 0px;border-style: solid;border-color: #3e3e3f;" data-width="100%"><section class="135brush" style="margin: 15px;"><p> 本报讯 由江西省赣州市检察院提起的该省首例食品药品安全领域民事公益诉讼案，赣州市中级法院日前作出一审判决，判令被告郭某支付10倍惩罚性赔偿金32.98万余元；并承担现场扣押的5780斤硫磺熏制辣椒的销毁费用；在《赣南日报》或赣州广播电视台公开向社会公众赔礼道歉。检察机关的诉讼请求全部得到支持。</p><p> </p><p> 2017年8月，信丰县公安局和工商部门在郭某家中查获1.49万斤辣椒。办案人员当场提取半干辣椒和湿辣椒样品送检，并现场扣押辣椒5780斤，现场查封剩余辣椒9163.8斤。经抽样检验，涉案半干辣椒和湿辣椒中二氧化硫含量均超过食品安全国家标准上限20多倍。其后，郭某私自撕去封条，将现场查封的9163.8斤辣椒销售流入市场。郭某因生产、销售不符合安全标准的食品罪，被判处拘役五个月，并处罚金1万元。</p><p> </p><p> 信丰县检察院在履职过程中发现该案件线索后移送赣州市检察院。赣州市检察院对郭某生产销售硫磺熏制食用辣椒、损害众多不特定消费者权益一案立案调查。在依法公告后，该院决定提起民事公益诉讼。今年6月，赣州市检察院向法院提起民事公益诉讼，提出要求被告郭某支付其所生产销售的硫磺熏制食用辣椒价款10倍的赔偿金；承担现场扣押硫磺熏制辣椒销毁费用，消除食品安全隐患；在市级以上媒体公开向社会公众赔礼道歉等三项诉讼请求。法院经审理认为，郭某的行为损害了不特定消费者的生命健康权，除应受到刑事处罚外，还应承担相应的民事侵权责任，赣州市检察院请求得当有据，依法予以支持。</p><p> </p><p> 办案中，赣州市检察院在江西省检察院指导下，探索性地提出10倍惩罚性赔偿等诉讼请求，积极与法院进行沟通。同时，及时补强相应证据，通过疾病预防控制中心、价格认定中心等权威机构出具专业意见，有效地解决了损害后果认定难的问题。</p><p><br></p></section></section></section><p style="max-width: 100%;min-height: 1em;overflow-wrap: break-word !important;"><br></p><p style="max-width: 100%;min-height: 1em;overflow-wrap: break-word !important;"><span style="max-width: 100%;color: #888888;overflow-wrap: break-word !important;"><font size="2">来源：检察日报 </font></span></p></section></section><p></p>
