line-height: 2em; text-indent: 2em;">（二）整改和处置范围：2010年2月及2011年1月在环城西路东西侧公开拍卖的242块地中涉及的欠缴、拖缴土地款或超出规划设计条件的违法违章建筑行为。</p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;">（三）整改和处置期限：非国家公职人员接受整改和处置的时间为2016年12月25日至2017年4月15日。</p><section class="_135editor" data-tools="135编辑器" data-id="86443" style="font-size: 16px; line-height: 2em; text-indent: 2em;">整改方式包含自行拆除、缴交处罚款或自行拆除与缴纳罚款相结合的方式，涉及人员可自行选择相应整改方式。未缴清土地款的，需先缴清土地款后（2017年1月25日前缴清的，免收滞纳金）再整改。</p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;">2017年1月26日起缴交土地款的，按照国有建设用地使用权《出让合同》第三十条规定，受让人自滞纳之日起，每日按迟延支付款项的0.5‰向出让人缴纳违约金。</p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;">对非国家公职人员在2016年12月24日前按《关于国家公职人员及其直系亲属参与环城西路“两违”行为限期接受整改和处置的方案》（寻办发电﹝2016﹞80号）文件规定，全额缴清土地款和超建面积处罚款的视为主动接受处置，并对超建面积处罚款给予适当奖励，即按实缴超建面积处罚款总额的3%给予奖励。</p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;"><strong>1．选择自行拆除的情形：</strong></p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;">非国家公职人员在2017年3月10日前自行拆除整改到位的，免于违法占地和违章建设处罚及其它法律责任。</p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;"><strong>2．选择缴交处罚款的情形：</strong></p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;">（1）对非国家公职人员在2016年12月25日—2017年3月10日（为期76天）主动缴交处罚款的：一般违章的（违章建筑面积占合法总建筑面积不超过15%（含），下同），处罚款计算方式为：实际总建筑面积×个人建房工程造价×5%；严重违章的（违章比例超过15%，下同），处罚款计算方式为：实际总建筑面积×个人建房工程造价×5%+超建面积×房屋综合评估价×50%；超占地违章的，在严重违章处罚的基础上，对超占地部分按每平方米10元标准进行处罚，并补缴土地出让金。</p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;">（2）对非国家公职人员在2017年3月11日—3月31日（为期21天）主动缴交处罚款的：一般违章的，处罚款计算方式为：实际总建筑面积×个人建房工程造价×6%；严重违章的，处罚款计算方式为：实际总建筑面积×个人建房工程造价×7%+超建面积×房屋综合评估价×70%；超占地违章的，在严重违章处罚的基础上，对超占地部分按每平方米20元标准进行处罚，并补缴土地出让金。</p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;">（3）对非国家公职人员在2017年 4月1日—4月15日（为期15天）主动缴交处罚款的：一般违章的，处罚款计算方式为：实际总建筑面积×个人建房工程造价×7%；严重违章的，处罚计算方式为：实际总建筑面积×个人建房工程造价×8%+超建面积×房屋综合评估价×80%；超占地违章的，在严重违章处罚的基础上，对超占地部分按每平方米30元标准进行处罚，并补缴土地出让金。</p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;">拒绝在上述阶段缴清所有处罚款的，一律按《县环城西路出让地块个人违章建房处理方案》（寻办发电﹝2015﹞19号）执行。</p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;">个人建房工程造价和房屋综合评估价分别按《县环城西路出让地块个人违章建房处理方案》出台时所评估的1200元/平方米、3000元/平方米执行，如违建人对此有异议，可申请县房管局通过招投标形式确定第三方评估机构重新进行评估，但必须按本方案先执行，实行多还少补。超占地违章的土地出让金由县国土局按当时该地块“招拍挂”价格确定。</p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;">对参与环城西路“两违”行为的非国家公职人员在上述规定期限内或之前主动接受处理、整改到位的，免于违法占地、违章建设处罚和拆除之外的其他法律责任。</p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;"><span style="color: #FF0000;"><strong>（二）处置阶段（2017年4月16日后）</strong></span></p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;"><br></p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;">（一）加强组织领导。本方案由县“两违”整治工作领导小组统筹推进实施，县国土局、城建局负责对非国家公职人员参与环城西路“两违”情况进行分类审核把关，依照有关法律法规，分别作出相关行政处罚告知书，并送达行政处罚决定。</p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;">（二）严肃责任追究。对抽调参与环城西路处置的工作人员，有失职渎职、徇私舞弊等行为的，按《寻乌县城乡违法违章建设查处及责任追究暂行办法》（寻府办字〔2016〕21号）严肃追究责任。</p><p style="font-size: 16px; line-height: 2em; text-indent: 2em;">（三）强化后续管理。在建房户提供完整齐全的资料后，县国土局、城建局、房管局应及时为整改或处置到位的违建房屋依法依规办理相关权属证明。对本方案出台前已缴清处罚款，且对应处罚款高于本方案计算标准的，其多缴部分由县财政局按财务管理程序依法返还。环城西路“两违”罚没款可优先用于解决该区域基础设施建设。</p><p style="font-size: 16px;
